    Richten in eigener Sache – Stimmrechtsausschluss (auch) bei der Einziehung von Aktien aus wichtigem Grund?

    „Gesellschaftern ist es grundsätzlich verwehrt, als Richter in eigener Sache abzustimmen. Es handelt sich dabei um einen allgemein anerkannten, das gesamte Verbandsrecht durchziehenden Rechtsgedanken. Auch der von einer Einziehung aus wichtigem Grund betroffene Gesellschafter ist danach vom Stimmrecht ausgeschlossen.“
