    Zahlungsunfähigkeit kommt als Insolvenzgrund zurück

    „Der Koalitionsausschuss der Regierungsparteien hat in seiner Sitzung am 25.08.2020 beschlossen, die Aussetzung der Insolvenzantragspflicht teilweise fortzusetzen. Ausgesetzt wird weiterhin – und zwar (vorläufig) bis zum 31.12.2020 – die Insolvenzantragspflicht bei Überschuldung. Es kommt also am 01.10.2020 der Insolvenzgrund der Zahlungsunfähigkeit zurück.

    Damit hat sich das in Fachkreisen vielfach geforderte Modell durchgesetzt, eine differenzierte Folgeregelung bei der Aussetzung der Insolvenzantragspflicht zu treffen. Die Aussetzung der Insolvenzantragspflicht war durch das Covid-19-Insolvenzaussetzungsgesetz (COVInsAG) zunächst befristet bis zum 30.09.2020 eingeführt worden.“
