Equipping the Works Council with Video Conferencing Technology

The Berlin-Brandenburg Regional Labor Court (Landesarbeitsgericht Berlin-Brandenburg, LAG) has ordered an employer by way of an interim injunction to provide the existing works council with technical equipment enabling it to hold meetings and consultations in the form of a video conference. In its reasoning, the Court stated that this was necessary information technology that the employer was required to provide pursuant to Section 40 (2) of the German Works Constitution Act (Betriebsverfassungsgesetz, BetrVG). No appeal can be filed against this decision (decision of April 14, 2021 - 15 TaBVGa 401/21).
