    Ohne Arbeit kein Bonus?


    Variable Vergütungsbestandteile müssen bei Krankheit und Urlaub fortbezahlt werden. Doch von diesem Grundsatz gibt es Ausnahmen. Michael Riedel erklärt, welche Regeln im Arbeitsverhältnis gelten.

     

    Ohne Leistung keine Gegenleistung - von diesem allgemeinen zivilrechtlichen Grundsatz gibt es im Arbeitsrecht viele Ausnahmen. Bezahlter Urlaub und Lohnfortzahlung im Krankheitsfall sind vielleicht die bekanntesten. Auch wenn Arbeitnehmer in diesen Fällen keine Arbeitsleistung erbringen, bleibt der Anspruch auf Vergütung bestehen.“
