Lawyers of the Moscow office of BEITEN BURKHARDT participated as Arbitrators in the V.P. Mozolin Moot Competition for Arbitration of Corporated Disputes

Moscow, 5 December 2017 - Lawyers of the Moscow office of BEITEN BURKHARDT Alexander Bezborodov, Anna Klimova  and Sergey Morozov participated as arbitrators in the V.P. Mozolin Moot Competition for Arbitration of Corporate Disputes.

In the context of the completion of arbitration reform in Russia in 2017, the Competition was dedicated to the most pressing issues in the arbitration of now officially arbitrable corporate disputes (we wrote here in more detail about the reform and about the arbitration of corporate disputes), including:

  • the invalidity of transactions concluded to the detriment of a company’s interests;
  • the liability of the company director for actions that contravene the company’s interests;
  • interim measures in corporate disputes;
  • the inclusion of an arbitration clause in the company’s charter and its application to the directors of a company and third parties;
  • the enforceability of agreements on the arbitration of corporate disputes.

The Competition was organised by the Institute of Modern Arbitration. In 2016, the Arbitration Center was set up at the Institute of Modern Arbitration. At present, it is one of the four permanent arbitration institutions in Russia to which corporate and other disputes may be transferred for resolution.

In the run-up to the Competition, a conference was held, which announced the launch of a young arbitration organisation in Russia – the Council of Modern Arbitration (Young IMA). Sergey Morozov was appointed Co-Chair of the Council.
