Administrative Law

Our Constitutional and Administrative Law Team primarily advises the public sector and includes both specialists for administrative law and members who were previously part of public administrations. We provide advice on public law and regulation, including fundamental public law issues, and form inter-disciplinary teams with colleagues, who specialise in other areas of law, such as labour and employment, tax or corporate law, in order to develop comprehensive solutions for our clients.

  • Our work on privatisations and public-private partnerships is of note. We structure privatisation projects and advise clients on the selection of contracting partners for PPP projects, taking into consideration the interplay between procurement and corporate law issues.

  • We draft and negotiate all manner of contracts and provide support with their performance and with contract management. We also advise on all related issues, such as administrative organisation, civil service law, finance and budgetary law issues, and fees (charges, contributions, special duties).

  • Our  state aid experts structure projects to maximise eligibility for subsidies and help with the application for and notification of aid. We also represent clients with respect to the recovery of subsidies, including in EU infringement proceedings.

  • We regularly assist with the acquisition of permits, licences and approvals, regardless of the type, even across borders where necessary.

  • We represent the interests of our clients in administrative proceedings, before supervisory and regulatory authorities, in arbitration, as well as before European and German courts. This includes extraordinary remedies, such as in the case of certain claims under constitutional law. In addition, we pursue claims for damages and trace compensation for our clients, for example in relation to claims arising under public liability law.

  • Our Constitutional and Administrative Law Team reviews and actively supports legislative projects and legal developments at European and national levels in fields that affect our clients.
