    Special Newsletter with regard to the Combined Heat and Power Act (KWKG) 2017 and Amendment of the Renewable Energy Act (EEG) self supply resolved, December 2016


    Dear Readers,

     

    After the German Bundestag's Committee for economy and energy had resolved on its decision recommendation on 14 December 2016 (BT-Drs. 18/10668), on 15 December 2016 the German Bundestag adopted the draft law concerning the modification of provisions for the generation of electricity by way of heat and power cogeneration and for self supply (BT-Drs. 18/10209; see also the blog posts Dr. Maximilian Emanuel Elspas and Sebastian Berg) in the recommended version (plenary protocol 18/209, p. 20976 et seq.). On 16 December 2016 the German Bundesrat decided not to file an application pursuant to Art. 77 (2) GG (Basic Constitutional Law of the Federal Republic of Germany) (BR-Drs. 767/16 (Decision)). As a consequence the way is now cleared for the amendment of the KWKG and the EEG self supply to come into force on 1 January 2017.

     

    The law consists of 18 articles, without consideration of the provisions on entry into force. Regardless of this, the focus lies on the amendment of KWKG 2016 and the EEG self supply. The modifications of the EEG self supply have after all grown quite voluminous whereas the amendment of the KWKG 2016 results in a fundamental conversion of the remuneration scheme.
